1Introduction & Acceptance of Terms
By accessing or using the Bachir Ice Cream delivery application ("the App" or "Service"), you confirm that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms"). These Terms constitute a legally binding agreement between you ("User", "you") and Bachir Ice Cream ("we", "us", "our"). If you do not agree with any part of these Terms, you must cease use of the App immediately.
2Eligibility
You must be at least 16 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. The App is intended for personal, non-commercial use within our service area in Lebanon.
3Account Registration
To place orders, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any suspected unauthorized use of your account.
3.1 We support the following sign-in methods: email and password, Google OAuth, and WhatsApp phone verification (OTP).
3.2 You are responsible for keeping your contact information accurate and up to date.
3.3 We reserve the right to suspend or terminate accounts that provide false or misleading information.
4Orders & Order Processing
4.1 All orders are subject to product availability and your delivery address falling within our active service area.
4.2 By placing an order, you make an offer to purchase. We reserve the right to accept or decline any order at our sole discretion, including where a product is unavailable, where there is an error in pricing or description, or where your address falls outside our delivery zone.
4.3 An order is confirmed only once you receive an in-app confirmation. Placing an order does not guarantee its acceptance.
4.4 A minimum order value of $5.00 USD applies to all orders (excluding the delivery fee).
4.5 Orders may not be modified once submitted. Please review your order carefully before placing it.
5Pricing & Payment
5.1 All prices are displayed in US Dollars (USD). A Lebanese Pound (LBP) equivalent is shown for reference only, calculated using the prevailing exchange rate applied by us. The USD price is the binding amount.
5.2 Prices are subject to change at any time without prior notice. The price applicable to your order is the price displayed at the moment you place the order.
5.3 A flat delivery fee of 150,000 ل.ل applies to all orders and is shown separately before you place the order.
5.4 Payment is accepted by cash on delivery only. Please have the correct amount ready at the time of delivery. We do not currently accept credit/debit cards, bank transfers, or digital payment methods.
5.5 Any promotional or loyalty discount applied through a code is capped at a maximum of 600,000 Lebanese pounds (LBP) of discount per order, after our standard USD/LBP conversion and rounding rules.
5.6 We are not responsible for any bank charges, currency conversion fees, or other costs incurred by you in connection with a transaction.
5.7 Promotional or loyalty discount codes cannot be combined with bundle offers in the same cart. If your cart contains a bundle, any applied code discount is removed; if you apply a code, it will not apply while a bundle remains in the cart.
6Delivery
6.1 We deliver to addresses within our defined service area in the Metn region and surrounding areas of Lebanon. Delivery availability is determined by the location you select in the App.
6.2 Estimated delivery times displayed in the App are calculated based on driving distance from the nearest active store and are approximate only. Actual times may vary due to traffic, weather, order volume, or other conditions beyond our control.
6.3 You are solely responsible for providing an accurate and accessible delivery address. We are not responsible for failed or delayed deliveries resulting from incorrect or incomplete address information provided by you.
6.4 Delivery is available only during our stated operating hours for the selected location. Orders placed outside operating hours will not be processed.
6.5 Our driver will contact you before or upon arrival. Please ensure that you or an authorised person is present and available to receive the order.
6.6 Risk in and title to the products passes to you upon delivery.
7Cancellations & Refunds
7.1 You may request a cancellation only before preparation of your order has commenced. Once preparation begins, cancellation is not possible.
7.2 To cancel, contact us immediately via WhatsApp through the Help section of the App. Cancellations requested through any other channel cannot be guaranteed.
7.3 Our products are freshly prepared, perishable food items. Accordingly, we do not offer refunds or exchanges once an order has been delivered.
7.4 If you have a genuine complaint regarding the quality or condition of your order upon delivery, please contact us within 24 hours via WhatsApp with relevant details (including photos where possible). We will assess each complaint on a case-by-case basis at our sole discretion.
7.5 In the event of a failed delivery caused by circumstances within our control, you will not be charged for that order.
8Loyalty Program
8.1 The Bachir Loyalty Program allows eligible registered users to earn stamps on qualifying orders and redeem them for rewards, subject to the terms set out in this section.
8.2 One (1) stamp is earned for each successfully delivered order with a total value of $15.00 USD or more (before the delivery fee). Orders below this threshold do not earn stamps.
8.3 Current rewards are: (a) 5 stamps — one free 600g take-home box (half kilo); (b) 10 stamps — one free 1 kg box plus a 15% discount applied to that same order.
8.4 Stamps and rewards are linked to your individual account. They are non-transferable, cannot be exchanged for cash, and hold no monetary value.
8.5 We reserve the right to modify, suspend, or terminate the Loyalty Program at any time, including changes to stamp thresholds, reward types, eligibility criteria, and program cycles, without prior notice.
8.6 After redeeming the 10-stamp reward and completing a program cycle, no further stamps will accumulate until a new cycle is published by us.
8.7 We reserve the right to void stamps or rewards in cases of suspected fraud, abuse, manipulation, or breach of these Terms.
9User Conduct
By using the App, you agree not to:
- Use the App for any unlawful, harmful, or fraudulent purpose
- Provide false, inaccurate, or misleading information
- Attempt to gain unauthorised access to any part of the App or its related systems or networks
- Interfere with or disrupt the operation of the App or the servers and networks connected to it
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
- Use automated tools (bots, scrapers, etc.) to access or interact with the App
- Infringe any intellectual property, privacy, or other rights of any person
10Intellectual Property
All content, trademarks, trade names, logos, graphics, and other materials available through the App are the exclusive property of Bachir Ice Cream or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the App solely for personal ordering purposes. You may not reproduce, distribute, modify, or create derivative works of any App content without our prior written consent.
11Third-Party Services
The App integrates third-party services to function, including Supabase (database storage and authentication infrastructure) and Google (OAuth authentication). Your use of features that involve these services is also subject to their respective terms of service and privacy policies. We are not responsible for the practices, availability, or content of any third-party service provider.
12Disclaimers
12.1 The App and its services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
12.2 We do not warrant that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
12.3 We make no warranty as to the accuracy, completeness, or fitness for purpose of any information provided through the App.
13Limitation of Liability
13.1 To the maximum extent permitted by applicable law, Bachir Ice Cream and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App or its services.
13.2 Our total aggregate liability to you for any claim arising from or related to these Terms or your use of the App shall not exceed the total amount paid by you for the specific order giving rise to the claim.
13.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
14Governing Law & Dispute Resolution
These Terms are governed by and shall be construed in accordance with the laws of the Republic of Lebanon. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the competent courts of Lebanon.
15Changes to These Terms
We reserve the right to update or modify these Terms at any time. Any changes will be effective upon posting the revised Terms in the App, indicated by a new "Last updated" date. Your continued use of the App after such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
